Disgraced former public protector and current EFF MP Busisiwe Mkhwebane has resorted to crude nativism after a costly further legal defeat in the Supreme Court of Appeal this week.

Mkhwebane had attempted to appeal a Western Cape High Court decision dismissing her application to remove the chair of the historic Section 194 impeachment inquiry into her fitness to hold office.

On social media, Mkhwebane claimed she had been “disappointed” by the ruling by Supreme Court of Appeal (SCA) Judge Visvanathan Ponnan on behalf of a full bench who struck the matter from the roll, stating that “political posturing” did not belong in the country’s courts.

Fellow judges included Caroline Nicholls, Billy Mothle and acting justices Mokgere Masipa and Evette Dippenaar.

Raw nativism on display


Mkhwebane soon hit back, attacking the judiciary and the SCA, saying that Ponnan “leading the judgment, displayed noticeable arrogance and dismissiveness throughout the proceedings”.



She continued that her “ongoing struggle” had involved “key figures, predominantly of Indian descent, who have positioned themselves as my persecutors”. 

She named these individuals as including the late Pravin Gordhan, Section 194 evidence leader, advocate Nazreen Bawa, Parliament’s chief legal adviser, Zuraya Adhikarie, “so-called expert witness” Hassan Ibrahim, witness Ivan Pillay and parliamentary legal adviser Fatima Ebrahim.

“Judge Poonan’s attitude further underscores the challenges and biases I have faced in my quest for justice.”

Mkhwebane failed to mention advocate Ncumisa Mayosi, who formed part of the team but does not seem to fit into the EFF MP’s racist short-sightedness.

‘Ingrained bias’


Mkhwebane charged that the striking of her case from the roll by the SCA revealed “a deeply ingrained bias that continues to obstruct genuine justice”.

“The SCA’s decision to strike my appeal marks a significant setback, not just for me personally but for all those who believed in my role as a protector of public rights and accountability,” she complained. 

Parliament later hit back at Mkhwebane, saying her utterances and accusations were “unwarranted”.

Parliament spokesperson Moloto Mothapo said “there is no merit to the attack levelled against these legal advisers, who have served Parliament with diligence and integrity over the years”.

The attack and the “racial slurs” were regrettable, he added, particularly “in a democratic society such as ours, where human dignity should be protected and respected”.

“As an MP and a public representative who owes allegiance to our Constitution, advocate Mkhwebane has a responsibility to uphold and protect the values enshrined in the Constitution, which are the cornerstone of our democracy.” DM

I am relieved to hear that her appeal has been struck from the role. And I hope she has been billed accordingly by the court. At least she can't get her hands on her pension money - I think that is enough punishment in itself!

She's simply proving that her impeachment as Public Protector was 100% correct. Regretfully she now sits in parliament and will pull the average IQ and levels of honesty on the EFF benches down even further. If that's possible.

It is always astounding that people of her nature can never see how they were to blame. She cost the taxpayer millions, took advantage of her position and finally was deservedly impeached. Cannot be her fault, it's those racist Indians to blame.

Just a question, based on her rediculous racial claims that the "Indians" are out to get her , how impartial was she when "performing" (??) her duties as the P P? We can assume she has not suddenly become so personally racially sensitive, but is rather now displaying her real racial bias.

We must all write to Speaker Didiza (speaker[at]parliament.gov.za),asking her to refer Mkhwebane to the ethics committee. The justice committee has oversight over the judiciary and all its members are bound by section 165(4) of the constitution to take measures to protect the dignity of the courts.

Why are Mkhwebane's racist remarks not dealt with? To intone that people of Indian descent cannot do their jobs in the judiciary is racist. '"Racial slurs" are "regrettable"'... no accountability.

I would think her comments as an advocate should bring her before an enquiry about her fitness to hold office. Her attack on members of the judiciary cannot go unpunished. Chief Justice Maya needs to take a stand.

There is a common thread between all these poor victims. They are demonstrably unsuited and unqualified for the high office they held or hold. The Bar Council should complete the process and remove Ms Mkhwebane from those entitled to practise law. She is a disgrace as is her advocate Mpofu.

She was never a real advocate. Anyone with an LLB can become an ‘advocate’. But until they pass exams, do pupillage, join a bar … She did law adjacent work and became PP. Never did any of that.

Just curious. If a white member of parliament made the same comments would these racial slurs have been passed off as "regrettable"? Whilst I think we are all sensitive to apartheid I do think we all need to be better at how we conduct ourselves and to set examples for others. Mkhwebane does not.

This is well and truly a dismal and poor reflection on Advocates. I am an Advocate of the High Court, I did my training and passed the bar exams (8 hour exam no less). As such I have duty to the Courts and ppl I serve. I consider it a privilege to appear in the superior courts. this is embarrassing
