Chaos Is The Point: Zuma threatens IEC, and daughter Duduzile attacks its Commissioner Janet Love

The Independent Electoral Commission of SA (IEC) is under attack from the surging MK party. In a late-night visit to the IEC results centre on June 1, the party’s leader, former president Jacob Zuma, warned at a press conference: 'Nobody must declare tomorrow. People will be provoking us.' He added: 'Don’t rush us. Nobody is going to announce tomorrow. We have more information to give.'

When asked what evidence the party had of vote-rigging, MK said it was sub judice, a legal concept that no longer exists in South African law as it is meant to protect a jury from influence. Instead, it is often used to shield information or spread disinformation under the cover of a mock legality.   

Zuma’s threat and demand are unprecedented in 30 years, where all parties which have run for elections have abided by IEC rules and felt fairly treated by its intricate system of consultation with party liaison committees.

The IEC said at a briefing that its results declaration on Sunday, June 2, will proceed as planned.

Zuma has a beef with the IEC, which stopped his candidature. As his start-up has romped into third position nationally and is KwaZulu-Natal’s largest party by far, he has steadily upped the ante against the electoral body, finally issuing the ominous warning.

Zuma is barred from standing as a candidate by the Constitution because he was sentenced to 15 months' imprisonment for contempt of court in 2021. The MK party insisted on putting him on its candidate list and then went to court when the IEC excluded him, forcing the institution into a court case. The ConCourt ruled against him, but that did not stop the attacks.

Three days before the May 29 election, MK party members illegally entered a voting station warehouse in Hammarsdale, KwaZulu-Natal, recorded the voting material stored there and then created a viral disinformation thread alleging the material was being used to rig the election.

The IEC explained why it was untrue and said it would take legal action against MK party members. The party has drawn the IEC into several similar battles ahead of Zuma’s eve of declaration gambit.

The purpose may be to destabilise the Commission and cast doubt over the election outcome. Zuma has been joined in his bid by African Congress for Transformation (ACT) boss Ace Magashule, who was dismissed as secretary-general by the ANC. He has gone on to start ACT, which received a tiny number, 0.2%, of votes, with 99% of the voting districts counted by 6pm on June 1.  

Magashule alleged the party was set to win the Free State, but the number of votes it received shows this to be patently untrue and almost comically exaggerated. 

However, with a slavish media contingent repeating every word of the allegations and with social media’s insatiable appetite, lies quickly can become truths. 

Zuma alleged that "the machines were being done things that's wrong”, he said about a short period when the IEC’s public-facing results portal went down. Now, MK has ratcheted up the tension, not only warning the IEC not to release the results as planned on Sunday, June 2, but also escalating its demands from a recount to a re-vote. 

At the results centre, MK’s Duduzile Zuma also demanded that IEC Commissioner Janet Love be arrested for alleged vote-rigging, as this Independent Media report shows. Love has come under repeated attack from MK for bias, even though both the Electoral Court and Constitutional Court have cleared her of pre-judging Zuma's candidacy. Both courts found that, at a media conference, all she did was set out what Section 47(2) of the Constitution says about when candidates sentenced to periods of imprisonment can and can’t stand for election. 

MK has signed up to the Electoral Code of Conduct, which enjoins parties not to attack the IEC, and to abide by its tried-and-tested systems of dealing with objections and allegations of electoral malfeasance. 


Explainer: what’s happening here?


There's no doubt there is some anger at the slam-dunk judgment the ConCourt made on Zuma's candidacy, not that he would ever go to Parliament. MK officials say he wanted to play a role in building the party outside. He's also 82 years old. 

MK's manifesto is anti-institution and anti-Constitution. It speaks, for example, about nationalising the SA Reserve Bank and holding a referendum to scrap the Constitution and replace South Africa's constitutional democracy with a “parliamentary" system. The attacks on the IEC are meant to dent its credibility and to throw it off balance. Undoubtedly, the MK leader is also fighting for his confidant and supporter Magashule, who has lost his position of provincial strongman to walk out in the political wilderness.

There is another, more ominous purpose. Zuma is position-bargaining by using his attacks on the IEC to influence the balance of forces in the ANC. The governing party is in a difficult position, facing a challenging future. It has lost the election, coming in at 40.2%. In this position of weakness, the ANC can go two ways. It can form a grand coalition or a government of national unity (GNU) with itself and the DA as the lead partners. Or it can make up with Zuma, fire Ramaphosa and enter into a radical populist pact with MK, EFF, ACT and other parties lining up for State Capture 2.0. 

There is a lot of support for this idea inside the ANC. The ANC's older and more sensible wing is leaning towards a GNU, and Zuma's gambit is to strengthen the hand of what is still a sizeable faction in the ANC he can call his own. Duduzile Zuma told Daily Maverick that many of its votes came from ANC sleepers, showing that reversing MK back into the ANC is still possible. MK has won 14.58% of the national vote, with 99% of voting districts counted. In KwaZulu-Natal, it has won 45.93%, making it the largest party and proving that ANC members have defected by the truckload. The ANC was at 17.63%, and the IFP at 16.29%, with 99% of the voting districts counted on June 1.

Now that the IEC has said the announcement will go ahead and President Cyril Ramaphosa has confirmed he will attend, Zuma has set the scene for a showdown with the wounded head of state, Trump-Biden style. His gauntlet is a show of force and an invitation to a duel. It's also unprecedented and enormously destabilising for South Africa's future and its, until now, unblemished young story of elections and electoral democracy. DM

The author has no substance so uses phyops to sway people like you. Nowhere in the article does the author show that they queried yhe IEC about Zumas claims. Why didn't the author tie the blackout during the us elections to the system down of the IEC. The author need to substantiate that the sub judice rule does not exist.& provide substance to their message they try to imitate the American style of push their personal narrative.

FYI But the new test for sub judice also makes it clear that politicians cannot refuse to answer difficult questions simply because the questions may relate to ongoing legal proceedings. This is because the sub judice rule does not prohibit, or prevent, discussions about legal proceedings from taking place. For sub judice to apply, it would be necessary for politicians to show that their answer would create a "real risk" that "demonstrable and substantial prejudice" would be caused to the administration of justice, were they to answer the question. In the vast majority of cases, it is unlikely that politicians would be able to show this. In other words, answering a question about pending or ongoing legal proceedings will not breach the sub judice rule, and the rule should not be invoked just to avoid answering a question which is embarrassing or difficult.

MK wanted a +50% for KZN. The results are tricky for them especially with EFF with 2% most of the parties below them are MPC and won't partner with them if ANC decides to back ab IFP led MPC coalition. They can see that numbe4s are not adding up to get KZN

And pretty much guarantees the end of the DA I fear. The ANC and it's 30 years worth of 'deployed cadres' didn't struggle to be poor and are organised around looting the state. I can't see how the DA as a junior partner in government could exert any positive influence whatever over the ANC.

ANC is in trouble now and both ANC and DA know this fact. DA just need to just squeeze for powerful positions. DA needs to get the nod from its core constituency, who believe it does not need the "dirty" ANC next to it. If not successful, they must take opposition benches and wait for the next, maybe two elections.

You are describing a win lose arrangement. The ANC DA have to show a win win. And that means the DA has some wins and the ANC has some wins. Both parties have to declare which of their principles are redlined are which they must produce, in the coalition, to show their supporters they have produced a win. Remember that the % of the vote are 40% ANC and 22% DA. The DA have 35% of the joint votes and must produce some significant wins

The problem is that this won't work bec the ANC is only keen on (a) retaining power (to the detriment of the country and its people); (b) having access to key govt. depts so that they can continue to loot and pillage the country's tax revenue and resources; and (c) having the (absolute) power to deploy their cadres into key govt depts and SOE's so that they can continue with their "work" under Points (a) and (b) above.

It seems after all zuma can do some matha. Because their 45% plus EFF 2% doesn’t add up to 50%. Interestingly the situation in KZN may well result in a solution for the whole country. Because if the ANC DA and IFP do get together with their more than 50%, they can freeze out zuma/ putin. And that collaboration will potentially duplicate itself in Parliament. Let’s see. And in all of this, it looks like the EFF will spend its time on the outside looking in.

2024 is as much a pivot point for our country as 1994. There are leaders (like Trevor Manuel) that could make the difference, where are they? Where are the churches this time - arguably the largest supporter base in the country? The country did not turn its back on the 55% ANC : the 15/55% MK split off and it was inevitable that they would, since it was a weird coalition itself all along. There is only one scenario that does not end in Zim 2.0 namely that leaders in ANC and MPC check their egos at the door and form a GNU.

Interestingly if one added up the votes cast for the ANC, EFF and MK for this election and compare for the previous gen election, one finds practically the same total reached by the then ANC. The DA meantime has barely changed its catchment area in 2 elections. So what does this mean? 2 things, the ANC supporters have divided themselves between the 3 parties this time who are all of whose leaders are mired in some or other aspect of corruption, state capture allegations etc. So the black electorate has demonstrably not found fault with these little pecadelloes of the ruling classes rather more interested in what is on offer for them or perceived threat to what they already receive in terms of ability to feed at the state trough! The DA does not offer these benefits so they are not supported as a rule. The other new parties welcomed by the chattering press who professed to do what the DA has been instructed to do ie go easy on BEE, get a black leader etc, well if they had done so, they would have lost out in the same way these ANC lite new parties have, despite vast financial support by gullible, so called Liberal business leaders!

KZN was reduced to a pile of wreckage by the combined efforts of Jacob Zuma and Cyril Ramaphosa over their hopeless presidencies. KZN is about to discover the true horror of family governance and out-of-control corruption. A government of national unity could save SA providing it served the nation instead of splitting at the seams of factionalism and confrontation. Imagine prosperity instead of destruction!

I am very optimistic and I trust our leaders. We have very good leaders in this country. They are going to put the country before their little several personal interests. There are leaders in the ANC, DA & other smaller parties. It's not all about the JZ & Malema noises. Our leaders will rise to this occasion and they are very much aware that there is no time to waste. I've said it before, ANC, IFP & MPC will rise. I must emphasize, tounge in cheek though "the New ANC, without the RET forces".

MK is not a normal political party, for those unaware of this fact this became quite clear in their reaction to their huge success. A normal party would've been very happy, if not to say overjoyed with their results, would've thanked all those who contributed to their success, etc. Instead, the glum looks on most of their faces indicated they expected even better results, and demanded a re-count. Dropped hints about another insurrection if their demands weren't met.. The nation must be wary in dealing with them and the EFF. Together they are 25% of the vote, the other parties must work out a plan to lead SA within the remaining 75%.

I also saw his face as he entered and walked around. Someone probably did the calculations and told him that between MK and EFF they do not have >50% of the seats in KZN. The EFF fell from almost 9.71% (2019) to 2.26% (2024) in KZN. If you look at the allocation of seats, and the fact that there are only six parties with seats, his sterling performance might come to a naught. That will be quite a bad joke.

Well, there you have it. The ANC has never dealt with the JZ decisively. Always covering, ducking, bending rules, tip toeing and dancing to please Msholozi. He will not form a coalition with the ANC. Chances are he will reverse the ANC into the MK party ... if they don't watch (and if he had more years). For the lucky remaining 85% of the population MK is just an one election puff. And we now know that the EFF is a tenner party. Thank you to the voters of South Africa. And there goes Julius' vice president ambition. The DA did at best poor. Nothing to brag here, get yourself a Coke Zero, not champagne. They are more stable than after the Mmusi fiasco as an organization, but in raw numbers ... Let me summarize it for you. You are the official opposition party in Parliament. Right? The majority party (ANC) just lost 17.32 percentage points! And of those 17.32 percentage points you were only able to pick up 1.04. Methinks you have a problem in the gearbox.

Zuma and his now desperate pigs got thrown from the feeding trough. It's to be expected they will do whatever they can to muscle their way back in. The question is whether the ANC will join the DA in a difficult and unprecedented coalition to see off the members they expelled, or ditch Cyril and let the Zulus get their way by joining with MK and the EFF. Given the ANC's rich history of own goals and the DA's myopic, intransigent idiocy, I think it's likely they'll both overplay their hands in negotiations with each other and we'll end up with what's worst for the country: ANC/MK/EFF.

I think Zuma is overcarried by his success and he is pushing things too far, also some kind of arrogance at play on his part, which is a shame for someone his age who should show a high level of maturity. Well concerning other opposition parties I am at pains to see the rhetoric from most newspapers trying to paint the DA as a good match for the ANC. Unless the ANC want to sell South Africa to the Western Countries. DA has no interest of South Africa but it is a foreign party operating within our shores. Ace Magashule on the other hand took a severe beating at the polls, and it is likely that he will be forgotten soon.

Zuma's continued disregard for legal processes, shows how dangerous he is. He has ruined our economy with his 'friendship' with the Gupta's. This alone is is worth a treason charge, given that he swore as President to uphold the law and act in the best interests of the country. He has continued to challenge the judicial system in all the criminal cases he faces. He is a complete stranger to the truth, honesty and integrity. Where his value system lies, one can only wonder. His current rant about the IEC holds no real substance. There were thousands of MK (and other party) agents present in voting halls and no relevant objections were received by the IEC. It just goes to prove that Zuma's mouth has once again been engaged to rabble rouse and incite uprising. He is dangerous, a jackal. His experience as the head of intelligence for the original MK during the revolution has stood him in good stead as a master of disinformation. It's a real pity that more of his history as a brutal leader in the camps in Zambia during the apartheid era is not made public to show people who he really is and what he is capable of. Our saving grace is his age and the knowledge that he will not bother us for too many years.
